The Board of Zoning Appeals (BZA) is a quasi-judicial body empowered by Indiana law to hear and decide on petitions for variances from the Town of Chesterfield Zoning Ordinance.

The Board provides a vital "safety valve" for property owners who may face unique hardships due to the strict application of zoning rules, ensuring that development remains fair, consistent, and beneficial to the entire community.

Primary Functions:

  • Hear requests for Development Standards Variances.
  • Approve or deny Special Exception uses
  • Decide on Administrative Appeals from staff decisions.
  • Facilitate public hearings for zoning relief.

Public Participation & Legal Guidelines

To ensure a fair and transparent process, the Board of Zoning Appeals (BZA) operates under specific legal guidelines regarding communication and public testimony.

Communication with Board Members

In accordance with Indiana law, individuals may not communicate with any member of the Board of Zoning Appeals prior to a hearing with the intent to influence the member’s action on a pending matter.

Town staff may file a written statement with the board containing facts or opinions related to a pending matter no later than five days before the scheduled hearing.

Submitting Written Testimony

The BZA welcomes written testimonies in support of, or in opposition to, matters pending before the board. Please address all written correspondence to:
